From 1 October 2026 most employment tribunal claims get six months less one day, not three.
From 1 October 2026 the time limit for bringing most employment tribunal claims in England and Wales rises from three months less one day to six months less one day. The change is made by section 152 of and Schedule 12 to the Employment Rights Act 2025, brought into force on that date by S.I. 2026/954.
The one point most people will get wrong: the new limit does not apply to every claim brought after 1 October 2026. It applies by reference to a "relevant date", and if that date falls before 1 October 2026, the old three-month limit still applies, however late the claim is prepared.
