Website Terms of Use govern the relationship between a website operator and its users. They are distinct from Terms and Conditions of sale: T&Cs of sale apply when the customer buys something; Terms of Use apply to anyone accessing the site, whether they buy or not.
Any website that accepts user accounts, user-generated content, or permits any interaction beyond passive viewing needs Terms of Use. Platforms, SaaS products, marketplaces, forums, and any site that wants contractual protection against scraping, abuse or misuse needs them.
Acceptable use restrictions, account suspension and termination rights, intellectual property reservations, user-generated content licence (Defamation Act 2013 section 5 considerations where applicable), limitation of liability, governing law, and notice-and-takedown procedures.
